Lipshaw: Don't Blame Faculty for Legal Education's Problems

I've started working on an essay for a symposium on the future of legal education ... I decided to re-read a work I have cited in the past, Donald A. Sch?n's The Reflective Practitioner: How Professionals Think in Action.?

All professions, in?Sch?n's view, demonstrate this tension between rigor (of research in technical disciplines) and relevance (of the application of knowledge to practice). ... The role of legal academy scholarship in practice falls somewhere in between the role of research in laporscopic surgical practice and the role of research in barbering practice. I will leave others to speculate on precisely where it falls. But in terms of how much pure or applied university-based research we actually need, I have a feeling our profession is closer to barbers than surgeons. ...??

Nevertheless, demonizing law professors in modal schools (the vast majority of which take seriously their obligation to train lawyers for non-academic careers) is like demonizing bankers or CEOs. It scratches an atavistic urge to attribute misfortunate to the gods. ... I don't particularly care for the U.S. tort system and its effect on product and medical costs, but attributing the crisis of legal education to current law professors because they get paid well or write theoretical "law and ..." articles is like attributing defensive medicine to the plaintiffs' medical malpractice bar because of the standard one-third contingent fee. People naturally do what they get measured on and paid well for. ?And it's perfectly legal to boot.

In short, blaming law faculty for responding precisely to the incentives the system creates is understandable but unreflective in its own way. Rather, the current problem is institutional and structural, as Brian Tamanaha, the late Larry Ribstein, Bill Henderson, and others have observed. Because of regulatory and accreditation restraints, almost all schools are similarly modal, so almost every law school, even well down in the lower rankings, consists of faculty with the same career drivers and motivations.

If one's school can't support and doesn't need a Department of Jurisprudence alongside the history, sociology, economics, and philosophy departments, maybe it shouldn't have one. Going that route would take some real cojones, and no doubt create more human candidates for status as gods or demons.

ITALY : An earthquake killed 16 people and injured about 350 in northern Italy on Tuesday, spreading fear among thousands of residents living in tents after a similarly strong tremor in the same region flattened their homes nine days ago. Rescuers were searching through the rubble of houses and warehouses in the Emilia-Romagna region, where several building sites had just reopened after the previous quake on May 20.

Officials said 16 people were confirmed dead, more than twice the number killed in the May 20 quake that, like Tuesday?s, had its epicenter near the city of Modena. The number of those forced to leave their homes doubled to 14,000. Many residents ran out of buildings when they felt the 5.8-magnitude tremor, which hit shortly after 3 a.m. EDT just as operations to rebuild the quake-struck region were under way.

?As we were coming down the stairs, we heard the sound of crumbling houses around us. There was a big cloud of dust,? said 72-year-old Giulio in Cavezzo, a badly damaged village about 30 km (20 miles) from Modena where three died. Rescuers searched tirelessly for survivors despite initial operations being hampered by disruption to the mobile phone network and to the railway network around Bologna.

A woman was pulled alive from the debris of her house in Cavezzo after 12 hours searching, according to Sky Italia. The quake was the most deadly to strike Italy since 2009 when a tremor partially destroyed the central city of L?Aquila, killing about 300 people and leaving thousands homeless. With its streets deserted, Cavezzo looked like a ghost town. A shop in the centre still had fruit displayed on stalls outside in the street.

In a nearby empty coffee shop a half-eaten croissant was left on a plate on the bar and an apron lay on the floor. ?It?s a disaster, I?ve never seen anything like it. An endless series of very strong tremors after those of May 20, which had already pulled everything to its knees,? said a very shaken Stefano Draghetti, mayor of Cavezzo.

?We need a lot of help to restart, from those who can ? the state, the European community.? Italian media showed buildings and shopping malls shaking and collapsing under the force of the quake and ambulances racing across towns. Churches and factories were badly damaged. In Medolla, also near the epicenter, an electromedical equipment plant collapsed, killing a worker. Rescuers were frantically searching for three other workers still believed to be under the rubble, a Reuters witness said.

?The situation is one of great fear and uncertainty,? said Salvatore Iannizzotto, provincial head for the Modena police. ?The population was becoming more relaxed and slowly moving back into their homes. They have now left their homes again.? The civil protection service was setting up new emergency campsites to provide residents with shelter for the night.

DEADLY QUAKE WOUNDS ITALY

The quake hit one of the most productive regions in a country struggling with a deep economic recession. Farmers estimated the damage of the previous quake to agriculture in one of Italy?s most fertile areas at more than 200 million euros ($250 million). Sports car maker Ferrari and motorcycle firm Ducati closed their plants in the region for safety reasons. The world?s top pasta-maker Barilla, based in Parma, evacuated a plant for 15 minutes but said production had not stopped. Italian bank BPER closed around 20 branches for safety reasons while medical products company Sorin said its plant in Mirabella had been damaged.

The quake was felt across northern and central Italy, including in the most populous northern city Milan. The area was hit by several large aftershocks, one of 5.6 magnitude Schools and buildings were evacuated as far south as Florence. A soccer match between Italy and Luxembourg in Parma scheduled later on Tuesday was called off. Emilia-Romagna, famed for its cured ham and mature Parmesan cheese, is in the middle of the Po plain, traditionally considered safer than other areas of seismic Italy.

Several historic buildings, some hit by the previous quake, suffered further damage. In the town of San Felice sul Panaro whose imposing 14th-century Estense Castle was badly damaged in the quake just over a week ago, three workers were killed by a crumbling warehouse. ?The situation is very serious, some people are stuck under the rubble,? Alberto Silvestri, the town?s mayor, told Italian television. Italian media also reported serious damage to the Baroque cathedral of Carpi and the Te Palace in Mantua, an architectural masterpiece from the Renaissance.

Prime Minister Mario Monti, whose cabinet is due to approve fresh emergency measures on Wednesday, tried to reassure the population in an impromptu news conference. ?I want to assure everyone that the state will do all that it must do, all that is possible to do, as fast as it can to guarantee the return to normality in a region so special, so important, so productive for Italy,? he said. French President Francois Hollande?s office said France stood ready to provide Italy with any experts or logistical aid it might need. Greece was among the first nations to offer help.

A 3.8 magnitude quake was also felt in western Bulgaria on Tuesday, causing no casualties or serious damage, the National Geophysical Institute said. It had its epicenter near Pernik.

'Switched At Birth': Why This TV Show Tells The Story Of My Life

April is a junior at Lincoln Park High School. She?s a student reporter for The Mash, a weekly teen publication distributed to Chicagoland high schools.

ABC Family?s ?Switched at Birth? centers around Daphne Vasquez and Bay Kennish, two girls who were switched at birth, and the complications their families face. And Daphne is deaf ? as if being switched at birth isn?t dramatic enough.

I?m hearing impaired, so I was excited when I heard about the show ? finally, a show about hearing impaired teens! I want people to understand the lives of deaf and hearing-impaired teens, and I thought ?Switched at Birth? is perfect.

Sure, some of the plot lines are overly dramatic and often silly, with episode after episode of characters fighting over small things. However, the show?s portrayal of deaf teens? loneliness and struggles to fit in is dead-on. Daphne and I have similar experiences; I?m not deaf, but I studied lip reading and I have to compensate in difficult situations. Like Daphne, I have really supportive friends, but it?s hard for me to follow conversations in loud places or parties, so I still feel left out once in a while.

?Switched at Birth? shows people how hard it is for Daphne and me ? although we may make it look easy ? to keep up with the rest of the world. When walking around with a friend, I often have trouble hearing what they?re saying, as Daphne does in the show. Daphne prefers chatting one-on-one, as do I, because it?s easier to keep track of the conversation.

The major problem I have is that I need people to repeat what they say a lot, and sometimes after three times, they get frustrated. Daphne has this same problem ? oftentimes she?ll need something repeated in a dark room because it?s difficult to read lips.

Daphne also has met some people who give her a hard time because they don?t understand that she needs help. This is also well portrayed because I face the same problem almost every day and just have to learn to live with it. ?Switched at Birth? showcases all these situations well.

But the show also shows how Daphne is still a normal teenager who knows how to have fun: She watches movies and hangs out with her friends. This is why I love the show ? it shows that Daphne and I can both do the same things as everyone else does; we just do them a little differently.

USF baseball advances to Big East tournament final

The University of South Florida baseball team will play for the Big East Conference tournament championship.

After two Saturday elimination-game victories against Connecticut ? 1-0 during the day and 2-1 at night ? the Bulls (38-21) meet St. John's (36-21) in the championship game at noon on Sunday at Bright House Field in Clearwater.

The Bulls are expected to start ace senior left-hander Andrew Barbosa, a first-team All-Big East selection.

St. John's advanced with a 2-1 victory against Notre Dame.

Today's winner will receive an automatic bid to the NCAA tournament. USF, which hasn't played at an NCAA Regional since 2002, might already be in line for an at-large bid because of the four-game win streak that has propelled the Bulls into the Big East final.

The Bulls are playing in their first conference tournament baseball final since 2001, when they played in Conference USA. USF's last conference baseball tournament championship was 1995 in the Metro Conference.

Coach Lelo Prado's Bulls came into Saturday with an 0-5 mark against UConn at the Big East tournament. But USF completed a sweep in the night game, getting six strong innings from Nick Gonzalez and scoring both runs on wild pitches.

The Bulls began on the right foot in the opening game as senior right-hander Derrick Stultz (9-1), who missed the past two seasons with injury, tossed a complete-game three-hit shutout and helped to preserve USF's staff.

It was only the second complete game of Stultz's career, along with a win against St. John's on May 11, 2008.

Stultz, who faced 34 batters, got all the support he needed on Jimmy Falla's solo home run in the top of the fourth inning.

Italy friendly cancelled after earthquake

PARMA, Italy (AP) -Italy's friendly against Luxembourg has been canceled after another earthquake shook northern Italy on Tuesday.

A magnitude 5.8 earthquake hit in the morning, killing at least 10 people in the same region still struggling to recover from another deadly tremor on May 20.

The quake was just 36 miles (58 kilometers) east of Parma, where Italy was scheduled to play Luxembourg in a Euro 2012 warm-up match. The team hotel was evacuated briefly in the morning.

"Faced with what happened, to the tremors that keep coming, we're not playing the Italy game," Vincenzo Bernazzoli, president of the Parma province said. "In our region thousands of citizens have been devastated in a few hours. With the victims, with the continuing shocks, it didn't seem right to us to continue with the game. Football has to stop."

It is another disruption to Italy's preparations after the Azzurri training center was raided on Tuesday by police investigating a match-fixing scandal. Domenico Criscito was sent home after he was placed under investigation while Leonardo Bonucci is also reportedly under suspicion but has had no official warning and remains with the squad.

Italy went on to win the World Cup the last time it had its tournament preparations disrupted. The 2006 match-fixing scandal - known as Calciopoli - resulted in Juventus being relegated to Serie B for a season, plus points penalties for several other Serie A teams and lengthy bans for club and refereeing officials.

Well-educated Couples Have Long Had Better ... - Psychology Today

In my previous blog, I made the assertion that you do not have a ?50/50 shot? at a successful marriage. For any given reader, the odds could vary dramatically, depending on a number of factors I will continue to describe in upcoming blogs. What I do know is that compared to the population at large, more well-educated individuals have much lower rates of divorce and appear to have more satisfying marriages. As I mentioned previously, in my modern day sample (2008) of over 600 well-educated women, only 6% had divorced and nearly all rated their marriages as highly satisfying.??

This is not only true today?well-educated couples in generations past have also enjoyed better marriages. The parents of those in my sample are also very well-educated?65% percent of the fathers and 50% of the mothers have an advanced degree of some type (e.g. M.D., Ph.D., J.D., or Master?s level degree). In this well-educated set of parents, 80% of marriages are still intact. By their children?s estimation, the clear majority (75%) of these marriages are generally quite satisfying?fewer than 25% of their children view their parents? marriages are either ?a little dissatisfied (16.6%) or ?very dissatisfied? (7.8%).??

These results replicate the findings of the world's longest continuous study of physical and mental health, a study launched in 1937 that has followed 237 students at Harvard University through health, disease, and death. The lead researcher, Dr. George Vaillant, recruited only students judged by the Harvard College dean as ?promising adults? with ?no mental or physical health problems.? In tracking the marriages in the sample*, ?he measured marital satisfaction with these four specific questions:??

1. Solutions to disagreements generally come: 1=easily, 2=moderately hard, 3=always difficult, 4=we go without a solution.

2. How stable do you think your marriage is? 1=quite stable, 2=some minor weaknesses, 3=moderate weaknesses, 4=major weaknesses, 5=not stable

3. Sexual adjustment is, on the whole: 1=very satisfying, 2=satisfying, 3=at times not as good as wished, 4=rather poor.?

4. Separation or divorce has been considered: 1=never, 2=only casually, 3=seriously.??

The scores on these items were summed to provide the global measure of marital satisfaction. The score of someone who is blissfully happy in his or her marriage and feels that the marriage is absolutely perfect would have a score of 4 (1+1+1+1). To really understand the results of the Vaillant and Vaillant study, it's helpful to translate these numbers into meaningful statements. Someone with a perfect score would essentially be saying, ?We solve disagreements easily, our marriage is quite stable, our sex life is very satisfying, and we've never considered divorce, ever? (I wonder, would anyone other than a honeymooning newlywed ever score a 4?).

On the other end of the scale, the score of someone who is miserably unhappy with his or her marriage could be as high as 16 (4+5+4+3). ?In other words, someone with the highest score on this scale would essentially be saying, ?Our disagreements go unresolved, our marriage is not stable, our sex life is disappointing, and we have seriously considered divorce.?

The average ratings of the quality of marriage for husbands and wives in this sample over the first 15 years of marriage were 5 and 6, respectively. After 31 years of marriage, the average ratings for husbands and wives were 6 and 7, respectively.???

Here is an example of how we could translate these scores based on the meaning of the items. A score of 5 could hypothetically be translated as saying, ?Solutions to disagreements are generally easy to come by, we have never considered divorce, our marriage is quite stable, and our sexual relationship is satisfying.? A score of 6 could hypothetically mean ?Solutions to disagreements are moderately hard to come by, but our sex life is satisfying, our marriage is quite stable, and we've never considered divorce.? A score of 7 could hypothetically mean ?Solutions are not always easy to come by. Sometimes, negotiating is even moderately hard, so I'd say that our marriage has some minor weaknesses, but our sex life is still satisfying and we never think of divorce.? In other words, both husbands and wives in Vaillant?s sample rated their marriages as near perfect to begin with and still near perfect after 31 years of marriage!???

Isn?t it interesting that researchers have long known that well-educated people have much better marriages, yet this doesn?t often come up in discussions about the divorce rate? ?It seems to be a kind of ?open secret.? I wonder whether some hesitate to explore this phenomenon because it doesn?t sound politically correct to point it out? Perhaps it?s more comfortable to reference the statistic that 50% of marriages end in divorce and to talk in generalities about the qualities of good marriages? Ultimately, shying away from discussing this truth serves no one well. The goal of many of my future blogs will be to analyze and describe the reasons for such different outcomes in marriage?stay posted for more!?

The main cause of the current economic crisis is the boom-and-bust cycle that was caused by the Greenspan Fed. Years of artificially-lowered interest rates caused trillions of dollars in mal-investment in real estate and other industries, and now we must endure the bust. But crackpot egalitarianism within the Fed and, indeed, in the entire Washington establishment, has made the crisis infinitely worse.

In the early 1990s the Boston Fed did all that it could to fabricate ?evidence? of widespread lending discrimination against racial minorities. But when Peter Brimelow and Leslie Spencer of Forbes magazine asked Boston Fed official Alicia Munnel what evidence of discrimination she really had, she was forced to admit that she had none.

Fighting discrimination was not the Fed?s real goal. The real goal was to achieve a more ?egalitarian distribution? of housing, period. So under the phony guise of ?fighting discrimination? the Fed, the Congress, Fannie Mae, Freddie Mac, and myriad other federal government agencies forced, bribed, and extorted mortgage lenders of all kinds into making literally trillions of dollars in bad loans to unqualified borrowers. Countrywide Bank alone was praised by the Fed for making $600 billion in such loans (shortly before it went bankrupt).

The Fed?s ?smoking gun? in this entire charade is a Boston Fed publication entitled ?Closing the Gap: A Guide to Equal Opportunity Lending.? There is a gap, you see, between the value of real estate owned by middle- and upper-income Americans on the one hand, and lower-income Americans on the other. (There is also a luxury automobile gap, a two-week European vacation gap, a luxury boat gap, an expensive suit gap, and many others). The federal government has used all of its powers of threats, force, and intimidation over the past two decades to try to close the housing ?gap.? ?The Federal Reserve Bank of Boston wants to be helpful to lenders as they work to close the mortgage gap,? the publication states.

In addition to closing the ?mortgage gap,? the Fed also pressured lenders to adopt a more vigorous racial hiring quota system, presumably under the theory that minority loan officers would be more likely to acquiesce in the Fed?s dictates to make more mortgage loans to its political mascots, sub-prime borrowers.

The Boston Fed report claims that it is only offering lenders ?guidelines,? and ?suggestions,? but it is very clear that failure to obey the Fed?s ?guidelines? can lead to serious financial problems for any mortgage lender. The report states in bold type that ?Failure to comply with the Equal Credit Opportunity Act or Regulation B can subject a financial institution to civil liability for actual and punitive damages in individual or class actions. Liability for punitive damages can be as much as $10,000 in individual actions and the lesser of $500,000 or 1 percent of the creditor?s net worth in class actions.?

All lenders ? banks, independent mortgage companies, etc. ? were told that they needed to pay close attention to ?such laws and regulations as the Equal Credit Opportunity Act (Regulation B), the Fair Housing Act, the Home Mortgage Disclosure Act (Regulation C), and the Community Reinvestment Act.? A ?conscientious [bank] Board will recognize the potential liability associated with noncompliance . . .? Ah, the subtle power of suggestion.

The Fed instructed lenders to ignore traditional measures of creditworthiness when it came to ?minority and low-income consumers.? Traditional underwriting standards were said to contain ?arbitrary or unreasonable measures of creditworthiness.? ?Special standards? that ?are appropriate to the economic culture of urban, lower-income, and non-traditional consumers? were urged. For example, traditional underwriting standards take into consideration such things as age, location, and condition of a house, but these should be abandoned when it comes to sub-prime borrowers, said the Fed.

Traditional ratios of mortgage payments to monthly income can also be ignored, said the Fed. And besides, ?the secondary market [i.e., Fannie Mae and Freddie Mac] is willing to consider ratios above the standard? ones for other borrowers. ?Lack of credit history? should not be a factor either. ?Successful participation in credit counseling? was said to be an adequate substitute.

Lenders were repeatedly urged to ?work with special secondary mortgage market programs? such as those administered by Fannie and Freddie. Lenders were told to ?be aware that Fannie Mae and Freddie Mac have issued statements to the effect that they understand urban areas require different appraisal methods.? If a sub-prime borrower has a property appraisal problem, then the Fed or Fannie Mae could help to find ?another experienced appraiser? who would presumably see to it that the property was ?correctly? reappraised so that the sub-prime loan could be made. Iran: Enriched uranium traces a 'technical issue'

(AP) ? A top Iranian nuclear negotiator said traces of enriched uranium discovered at an underground bunker came from a "routine technical issue," the country's official IRNA news agency reported on Saturday.

Ali Asghar Soltanieh, Tehran's envoy to the U.N.'s International Atomic Energy Agency, was responding to a report by the nuclear watchdog in which it said it had found radioactive traces at an Iranian site.

The uranium found was at level that is slightly closer to the threshold needed to arm nuclear missiles than Iran's previous highest-known enrichment grade.

The IAEA said Friday in the report that it was asking Tehran for a full explanation about the traces. But the report was careful to avoid any suggestion that Iran was intentionally increasing the level of its uranium enrichment.

Iran said the find was a technical glitch, according to the report. Analysts and diplomats said Iran's version sounded plausible.

Soltanieh said the issue was blown out of proportion for political reasons.

"This issue shows that some intend to damage the existing constructive cooperation between Tehran and the International Atomic Energy Agency," he was quoted as saying.

The West suspects Iran is pursuing a weapons program. Tehran denies the charge, saying its nuclear program is aimed at peaceful purposes like power generation and cancer treatment.

Commonly used pesticide turns honey bees into 'picky eaters'

Biologists at UC San Diego have discovered that a small dose of a commonly used crop pesticide turns honey bees into "picky eaters" and affects their ability to recruit their nestmates to otherwise good sources of food.

The results of their experiments, detailed in this week's issue of the Journal of Experimental Biology, have implications for what pesticides should be applied to bee-pollinated crops and shed light on one of the main culprits suspected to be behind the recent declines in honey bee colonies.

Since 2006, beekeepers in North America and Europe have lost about one-third of their managed bee colonies each year due to "colony collapse disorder." While the exact cause is unknown, researchers believe pesticides have contributed to this decline. One group of crop pesticides, called "neonicotinoids," has received particular attention from beekeepers and researchers.

The UC San Diego biologists focused their study on a specific neonicotinoid known as "imidacloprid," which has been banned for use in certain crops in some European countries and is being increasingly scrutinized in the United States.

"In 2006, it was the sixth most commonly used pesticide in California and is sold for agricultural and home garden use," said James Nieh, a professor of biology at UC San Diego who headed the research project with graduate student Daren Eiri, the first author of the study. "It is known to affect bee learning and memory."

The two biologists found in their experiments that honey bees treated with a small, single dose of imidacloprid, comparable to what they would receive in nectar, became "picky eaters."

"In other words, the bees preferred to only feed on sweeter nectar and refused nectars of lower sweetness that they would normally feed on and that would have provided important sustenance for the colony," said Eiri. "In addition, bees typically recruit their nestmates to good food with waggle dances, and we discovered that the treated bees also danced less."

The two researchers point out that honey bees that prefer only very sweet foods can dramatically reduce the amount of resources brought back to the colony. Further reductions in their food stores can occur when bees no longer communicate to their kin the location of the food source.

"Exposure to amounts of pesticide formerly considered safe may negatively affect the health of honey bee colonies," said Nieh.

To test how the preference of sugary sources changed due to imidacloprid, the scientists individually harnessed the bees so only their heads could move. By stimulating the bees' antennae with sugar water, the researchers were able to determine at what concentrations the sugar water was rewarding enough to feed on. Using an ascending range of sugar water from 0 to 50 percent, the researchers touched the antennae of each bee to see if it extended its mouthparts. Bees that were treated with imidacloprid were less willing to feed on low concentrations of sugar water than those that were not treated.

The biologists also observed how the pesticide affected the bees' communication system. Bees communicate to each other the location of a food source by performing waggle dances. The number of waggle dances performed indicates the attractiveness of the reward and corresponds to the number of nestmates recruited to good food.

"Remarkably, bees that fed on the pesticide reduced the number of their waggle dances between fourfold and tenfold," said Eiri. "And in some cases, the affected bees stopped dancing completely."

The two scientists said their discoveries not only have implications for how pesticides are applied and used in bee-pollinated crops, but provide an additional chemical tool that can be used by other researchers studying the neural control of honey bee behavior. The study was funded by the North American Pollinator Protection Campaign and the National Science Foundation.

(AP) ? In the most unpredictable of playoff series, Rajon Rondo was the one consistent playmaker for Boston.

Until Game 6.

Rondo had his quietest game of the second round and the Celtics paid with an ineffective shooting night that left them playing catch-up against rugged and determined Philadelphia. The Celtics could never take that clutch late lead and now find themselves trying to avoid a monumental upset.

Jrue Holiday scored 20 points, and Elton Brand had 13 points and 10 rebounds to lead the Philadelphia 76ers to an 82-75 victory over the Celtics on Wednesday night that tied the Eastern Conference semifinals.Neither team has played well enough to seize control of the series by winning consecutive games. But the Sixers were good enough to win Game 6, improving to 5-0 this postseason in games following a loss. Game 7 is Saturday in Boston.

"It's nice to have it at home, but we've got to get it still," coach Doc Rivers said.

Paul Pierce, Kevin Garnett, Ray Allen and Rondo could be playing their last game together Saturday night if they can't find a way to hang onto the ball and put away a Sixers team that won't quit.

Boston has learned three times already how difficult that can be.

The fun for the Sixers started when former 76ers All-Star Allen Iverson earned a roaring standing ovation when he presented the game ball.

It ended with the song, "I'm Shipping Up to Boston," blasting through the arena.

"I want more," 76ers coach Doug Collins said. "We're going to get greedy. We want more."

The Celtics posted ugly numbers across the board: Blame the loss on the 33 percent shooting, the 17 turnovers or the 3 for 14 3-point shooting. Either way, there's enough to go around. Pierce had 24 points and 10 rebounds, and Garnett had 20 points and 11 boards.

Rondo had tortured the Sixers over the first five games, but was limited to nine points (4 for 14 shooting) and six assists.

He'll need to return to form at home for the Celtics to have a chance at avoiding the upset.

"I thought he was trying to orchestrate the offense and trying to go," Rivers said. "He probably got caught in the middle. It happens, but he'll be better."

The Sixers again failed to put up the sparkling numbers in the box score usually required for a deep postseason run. They missed 8 of 9 3-pointers, shot a woeful 17 of 28 from the free throw line and had 12 turnovers.

But when the Sixers really needed that game-changing basket, there was Evan Turner twisting and fighting through defenders down the lane. When the Sixers needed a stop, there was Brand, ripping a rebound away from Boston, even with painful neck and shoulder injuries that keep him awake at night.

"When you get out there, you don't feel much," Brand said. "You've got the adrenaline flowing. You're banging and fighting. That's why Coach has confidence in me to play 34 minutes."

The Sixers wrote "Huddle Up and Fight" on their locker room chalkboard. They did just that and are now one win from reaching the conference finals for the first time since 2001.

Iverson was the MVP of that run.

Maybe a little of that ol' A.I. magic rubbed off in Game 6.

Unlike Game 5, when the Sixers collapsed in the third quarter and blew a lead, they suddenly found a groove in front of 20,403 fans.

The Sixers started hitting free throws, kept turnovers to a minimum (two), and fed the ball to a starting lineup that had been largely outproduced by a fantastic bench. Turner was fouled on a go-ahead layup but missed from the line. That made the Sixers 5 of 13 while the Celtics were 14 for 14.

Iguodala split two defenders and threw down a ferocious dunk over Pierce to draw the foul. He made his first free throw after missing his first four and the Sixers led by five.

Pierce led the parade to the line for the Boston. He made his first 11 attempts for a Celtics team that was 17 for 17 through three quarters. The Celtics made only 19 field goals through three.

"We've got to move the ball and continue to play the defense that we've been playing," Pierce said.

The Sixers also couldn't find their way from the 3-point line and missed their first six attempts until Iguodala nailed one for a 58-52 lead.

Garnett caught some heat after calling Philly fans "fair weather" after Game 5 in Boston.

Well, the forecast called for thunderous cheers after Iguodala buried his 3. That helped the Sixers take a 60-56 lead into the fourth and put them 12 minutes away from Game 7.

This time, the Sixers weren't blowing a lead.

Turner, who never met a clutch attempt he didn't like, went right-to-left on a drive down the lane for a nine-point lead. The 6-foot-4 Holiday brushed off the 4-inch difference and went high over Garnett for a one-handed bucket and an 11-point lead.

"Someone else was talking bad about our fans, so it was good to get this victory for them," Brand said.

While the Sixers swapped shot makers on almost every possession, the Celtics never found that third and fourth option behind Pierce and Garnett.

"We never really established Kevin," Rivers said. "Even though Kevin had points, it wasn't the type of points we needed."

Iguodala and Turner scored 12 points. Lou Williams had 11 and the Sixers outscored Boston 42-16 in the paint.

"I just want our guys to play with no fear," Collins said. Collins had the Sixers watch a highlight video from Game 7 of the 1982 Eastern Conference finals on Tuesday. The Sixers blew a 3-1 lead in that series and were forced to win Game 7 at Boston to reach the finals ? which they did.

Thirty years later, the Sixers get to try again.

Notes: Iverson cupped his hand to his ear and received the loudest ovation of the night. He watched the game from a suite and his eyes watered up when he was shown later in the game on the big screen as the crowd, thousands wearing a No. 3 jersey, went wild and chanted, "MVP!" Iverson posted on Twitter, "You can always come home again!!!" ... Celtics assistant coach Tyronn Lue was famously stepped over by Iverson in the 2001 NBA finals. ... Celtics G Avery Bradley (shoulder) sat out. Rivers said Bradley and Allen are both considered day to day. ... Collins was stunned Iguodala was left off the NBA's all-defensive squad. Collins said Iguodala should have been "no worse than a second-team defender." ...
